  • You will examine the supplement and dietary recommendations offered by MyHappyGenes, Inc. through its website or reports and use your own clinical expertise, evaluation, and judgment to ensure that those recommendations pose no health risk or contraindications to your patients;
  • You recognize that the recommendations made by MyHappyGenes, Inc. are general and generated by an algorithm that calculates supplements by using the symptoms and genetic data provided by the patient and that it cannot calculate all possible health contingencies of the individual patient;
  • You recognize that supplements have the ability to cause discomfort and temporary symptoms in some patients, including but not limited to allergic reactions. You knowingly, voluntarily, and intelligently decide to receive the recommendations from the MyHappyGenes, Inc. portal and You knowingly, voluntarily, and intelligently assume all risks involved in the same. As a result of Your assumption of these risks, You agree to release, hold harmless, indemnify, MyHappyGenes, Inc and their agents from and against any and all claims which You (or Your representatives) may have for any loss, damage, or injury arising out of or in connection with use of the products or services offered through this Portal, or arising out of or in connection with referral to other practitioners or merchants for delivery of any services; and
  • You understand that MyHappyGenes, Inc. disclaims all warranties, both express and implied, including any warranty of non-infringement, fitness for a particular purpose or merchantability. MyHappyGenes, Inc. has no liability to you for any incidental and consequential damages, whether or not foreseeable or contemplated by MyHappyGenes, Inc. (including but not limited to any loss, cost, injury, or expense caused by, or resulting from, a delay in responding to You or one of your patients, whether from technical failures or otherwise).
